Terms of Service

1. Acceptance of Terms

By downloading, accessing, and using the FlashBrain mobile application ("Application"), you agree to comply with these Terms of Service ("Terms"). If you do not accept these Terms, you may not use the Application. These Terms constitute a binding agreement between you and FlashBrain.

2. Service Description

FlashBrain is a learning application based on scientific spaced repetition, offering AI-powered flashcard creation and management. The main features of the service include:

  • Flashcard creation and management
  • Study with spaced repetition algorithm
  • AI-powered card creation
  • Deck Explorer and ready-made content
  • Gamification features (XP, levels, badges, streaks)
  • Multiple study modes (flip, typing, multiple choice, listening)
  • Progress tracking and statistics

3. Account Creation and Use

3.1 Account Requirements

  • You must be at least 13 years old to use the Application
  • You must provide accurate and current information during registration
  • You are responsible for the security of your account and password
  • One person may only create one account

3.2 Account Responsibility

You are responsible for all activities performed through your account. You must notify us immediately if you detect any unauthorized use.

4. Subscription and Payment

4.1 Premium Subscription

FlashBrain Premium subscription is offered with monthly and annual options. Subscription fees are processed through Apple's App Store and are subject to Apple's payment policies.

4.2 Automatic Renewal

Subscriptions automatically renew unless canceled. You can cancel your subscription at any time from your App Store account settings.

4.3 Refund Policy

All payments are processed through the App Store, and refunds are subject to Apple's refund policies. FlashBrain cannot directly issue refunds.

4.4 Price Changes

We reserve the right to change subscription prices. When price changes occur, you will be notified in advance, and existing subscribers will maintain their current price for a reasonable period.

5. Content and Intellectual Property

5.1 User Content

Flashcards, decks, and other content you create ("User Content") remain your property. However, when you share your content on Deck Explorer, you grant FlashBrain a limited license to display and distribute this content to other users.

5.2 FlashBrain's Intellectual Property

All software, design, algorithms, code, and other content of the Application belong to FlashBrain and are protected by copyright. Copying, modification, distribution, or commercial use is prohibited without permission.

5.3 AI-Generated Content

Cards created by FlashBrain's artificial intelligence service are provided under license for your personal use. These contents should be used for educational purposes and cannot be published or sold in bulk.

6. Unacceptable Uses

The following uses are prohibited:

  • Illegal content sharing
  • Spam, malware, or harmful content distribution
  • Interfering with other users or the proper operation of the Application
  • Bypassing security measures or conducting reverse engineering
  • Using the Application for commercial purposes without permission
  • Creating multiple accounts or artificially inflating XP/statistics
  • Sharing offensive or hateful content

7. Data and Privacy

Use of your personal data is governed by our Privacy Policy. By accepting these Terms, you also accept our Privacy Policy. For detailed information on how we collect, use, and protect your data, please review our Privacy Policy.

8. Disclaimer

FlashBrain is provided "as is" and "as available." We do not guarantee that the Application will always operate uninterrupted or error-free. We are not responsible for:

  • Temporary interruptions or downtime
  • Data loss or corruption
  • Errors in third-party services
  • Guarantee of learning outcomes (FlashBrain is a tool; learning success is the user's responsibility)

9. Limitation of Liability

To the fullest extent permitted by law, FlashBrain and its developers shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the subscription fees you have paid in the last 12 months.

10. Indemnification

You agree to indemnify and hold harmless FlashBrain against all legal claims, costs, damages, and expenses arising from your use of the Application, your User Content, or your violation of these Terms.

11. Third-Party Services

The Application may include links to third-party services (cloud services, artificial intelligence services, etc.). Use of these services is subject to their own terms and privacy policies. FlashBrain is not responsible for the content, operations, or privacy practices of third parties.

12. Changes and Updates

12.1 Application Updates

We may update the Application from time to time. These updates may add new features, remove existing features, or change the general functioning.

12.2 Changes to Terms

We reserve the right to change these Terms at any time. When significant changes occur, we will notify you via email or in-app notification. Your continued use of the Application following the notification will constitute acceptance of the new Terms.

13. Termination

13.1 Termination by User

You can close your account at any time from the Application settings. Upon termination, your User Content and data will be deleted within 30 days.

13.2 Termination by FlashBrain

If you violate these Terms, conduct fraudulent activities, or harm the Application and other users, we reserve the right to suspend or permanently close your account.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Istanbul. However, if you reside in a country with mandatory consumer protection laws (e.g., EU countries), these laws may also apply.

15. Apple-Specific Terms

As FlashBrain is an iOS application, the following terms apply:

  • These Terms are between you and FlashBrain, not Apple. FlashBrain is solely responsible for the Application and its content.
  • The license granted is limited to non-transferable use on iOS devices that you own or control and as permitted by Apple's App Store Terms of Service.
  • Apple has no obligation to provide any maintenance or support services for the Application.
  • Apple is not responsible for any warranty claims related to the Application.
  • Apple is not responsible for addressing any claims from you or third parties related to the Application (product liability, legal compliance, intellectual property, etc.).
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
